All commercial transactions carried out by MEDIACREA PRODUCTION are subject to these General Terms and Conditions of Sale (hereinafter referred to as the "Terms and Conditions"). They define the contractual framework between any user of the website https://www.peralusa.com (hereinafter referred to as the "Website") wishing to make an online purchase (hereinafter the "Client"), and SAS MEDIACREA PRODUCTION, whose registered office is located at 24 rue des Archers, 91310 Montlhéry, France, registered with the Evry Trade and Companies Register under number 485 091 730 (hereinafter "MEDIACREA PRODUCTION").

MEDIACREA PRODUCTION reserves the right to modify or update these Terms and Conditions at any time. The applicable version is the one in force at the time of the order, available on the Website. Any modification will take effect upon publication online and will apply to orders placed thereafter.

By validating an order, the Client fully and unconditionally accepts these Terms and Conditions. The Client confirms that they possess the legal capacity required to enter into a contract in accordance with Articles 1123 et seq. of the French Civil Code.

Definitions

For ease of understanding within these Terms and Conditions:

  • Territory: refers to France (including overseas territories), Spain, Portugal, Belgium, Switzerland, and Luxembourg.
  • User or Visitor: any person accessing the Website from within the Territory, whether or not they make a purchase.
  • Client: any User who places an order through the Website.

The items offered for sale by MEDIACREA PRODUCTION on the website www.peralusa.com (hereinafter referred to as the "Products") are described and presented with the utmost care. Each Product has an individual information sheet detailing its main features, based on data provided by our suppliers, partners, or manufacturers. These details are provided for informational purposes and may vary slightly due to artisanal production or material differences.

The photographs and visuals displayed on the Website are intended to illustrate the Products. However, they are non-contractual, as color tones and textures may differ depending on screen settings or production batches.

MEDIACREA PRODUCTION may, from time to time, offer promotional campaigns (hereinafter "Promotions") on certain Products. Such offers may relate to pricing, delivery conditions, quantities, or other specific features. They are valid only during the stated period and while stocks last.

To place an order on the website www.peralusa.com and purchase a Product, the Client must:

  • Provide accurate personal and delivery information, in accordance with the data privacy policy;
  • Have a valid payment method (credit/debit card, SEPA transfer, or any other payment option offered on the Website).

Orders are placed exclusively online, following these steps:

  • The Client adds the desired Products to their shopping cart;
  • They enter their delivery details;
  • They review the available shipping options and related fees;
  • They select their payment method;
  • They accept the Terms and Conditions and confirm the order;
  • They are redirected to the secure payment platform EUPAGO to complete the transaction;
  • Finally, they receive a confirmation email acknowledging receipt and validation of their order.

The Client is solely responsible for ensuring the accuracy and completeness of the information provided, particularly their delivery address.

The confirmation email sent by MEDIACREA PRODUCTION constitutes acceptance of the order and forms the sales contract under these Terms and Conditions. This email summarizes the order details and includes the applicable version of the Terms and Conditions. The Client is advised to retain this email as proof of the agreement.

MEDIACREA PRODUCTION cannot be held liable for the loss or misclassification of this email by anti-spam filters or similar systems. The Terms and Conditions remain available at any time on the Website.

When purchasing a standard Product from the PERALUSA collection, the User may select and order any item listed in the permanent catalog displayed on the Website.

However, only the order confirmation sent by MEDIACREA PRODUCTION serves as proof of the actual availability of the Product.

If a Product becomes unavailable after the order has been confirmed, the Client will be informed as soon as possible, either by email or by telephone. Depending on the situation, the Client may be:

  • notified of a partial shipment,
  • informed of an extended delivery timeframe,
  • or advised of the cancellation of the unavailable item, in which case a full refund will be issued for the Product concerned.

MEDIACREA PRODUCTION strives to keep product information accurate and up to date but cannot be held liable for temporary stock shortages due to artisanal production or material availability.

Price Display

The prices of Products offered on www.peralusa.com are shown in euros (€) and include all applicable taxes (VAT) at the time of the order. Prices may vary during special offers or promotional campaigns.

Total Amount Payable

The total amount due corresponds to:

  • the price displayed on the Product page, and
  • any additional fees (delivery, customization, or optional services) clearly stated during the ordering process.

Any applicable discounts, vouchers, or promo codes will be deducted before final confirmation. The final price is confirmed only upon order validation.

Promo Codes and Vouchers

The Client may use promo codes or vouchers issued by MEDIACREA PRODUCTION. These are personal, non-transferable, and non-cumulative unless otherwise stated. They must be entered during checkout and are valid only within the period specified by the Company.

Shipping Fees

Shipping costs are borne by the Client. Their amount depends on the delivery method, destination, and parcel specifications. These fees are displayed in the shopping cart prior to order validation and must be approved by the Client. A shipping estimate may be generated through a purchase simulation on the Website, but only the amount displayed at checkout is binding. Additional charges may apply for deliveries requiring special handling (remote locations, restricted access, etc.).

Discounts and VAT

Payment for orders is due immediately upon confirmation, with no discount applicable. In the event of a VAT rate change, prices will be automatically adjusted to reflect the new legal rate.

Price Variations

Prices displayed on the Website may change at any time without prior notice. In the event of an obvious pricing or display error, MEDIACREA PRODUCTION reserves the right to cancel the affected order after notifying the Client. The prices in force at the time of order validation shall prevail.

Foreign Currency Payments

All prices are expressed in euros (€). If payment is made in another currency, conversion will be carried out according to the exchange rate applied by the Client's bank at the time of the transaction. MEDIACREA PRODUCTION has no control over potential variations in exchange rates.

Payments made on www.peralusa.com are fully secured. All transactions are processed by our payment service provider, EUPAGO – Instituição de Pagamento, Lda, a company licensed and supervised by the Bank of Portugal.

The shipment of items is limited to the Territory defined in these General Terms and Conditions. Delivery is carried out via a courier service or a specialized carrier, depending on the option selected by the Client at checkout, based on the weight, volume, and nature of the parcel. Each item may be shipped separately, depending on its availability.

Delivery Address and Information

When placing an order, the Client must provide accurate and complete delivery information, including full contact details and a valid phone number (landline or mobile). In the event of an error, omission, or incomplete address preventing successful delivery, MEDIACREA PRODUCTION and the carrier cannot be held liable for any delay, loss, or return of goods.

Carrier Delivery

For large or heavy items, delivery may be handled by a professional carrier. In such cases, the carrier will contact the Client directly by phone or email to arrange a delivery appointment (hereinafter the "Appointment"). The Client must inform the carrier of any access difficulties (narrow stairs, pedestrian area, no elevator, etc.), even if previously mentioned during the order process. It is also the Client's responsibility to verify that the access points (doors, corridors, elevators, etc.) allow for the delivery and placement of the ordered item. If delivery requires special equipment (such as a forklift or lifting device) due to access constraints reported by the Client, the Client must approve and cover the related costs prior to shipment.

The delivery times indicated at the time of order confirmation are expressed in business days and may vary depending on the Product. Due to differences in supply zones, artisanal production constraints, and logistical conditions, these times are provided for guidance only and may be subject to change.

MEDIACREA PRODUCTION makes every effort to meet the indicated timelines but cannot be held liable for any delays resulting from circumstances beyond its control, such as:

  • Transport disruptions,
  • Temporary stock shortages,
  • Weather conditions, strikes, or other force majeure events.

The Client will be notified as soon as possible of any significant delay or change in the estimated shipping date.

If delivery cannot be completed on the agreed Appointment Date due to incorrect information, unreported access difficulties, or the Client's absence at the scheduled time, additional delivery fees may be charged by MEDIACREA PRODUCTION.

In such cases, MEDIACREA PRODUCTION will contact the Client to arrange payment of the additional fees before any new delivery attempt. If these fees are not settled, the Company reserves the right to withhold delivery of the Product.

Any damage, deterioration, or loss resulting from such logistical issues shall be entirely borne by the Client.

If the Client wishes to change the delivery address or postpone the delivery date, they must notify MEDIACREA PRODUCTION as soon as possible and no later than three (3) business days before the initially scheduled delivery date.

Requests must be submitted via the Website "Contact" section and include:

  • the order number,
  • the Product(s) concerned,
  • the requested change (new address and/or new date) and a brief reason.

MEDIACREA PRODUCTION will confirm by email or phone whether the request is accepted or refused as soon as possible, and will indicate any impact on the delivery timeline.

Note: depending on logistics progress, some requests may not be feasible. Rescheduling is subject to carrier availability.

Upon delivery, it is essential that the Client unpacks the Product in the presence of the courier or carrier and verifies:

  • that the Product matches the order, and
  • that it is not damaged, before signing the delivery slip.

Claims and Reservations

In case of any irregularity, the Client must make specific and detailed reservations on the delivery slip.

These reservations must be:

  • handwritten,
  • dated and signed,
  • and must clearly describe the issue.

Generic comments such as "damaged product" or "subject to inspection" are not acceptable.

The Client must specify the exact nature of the defect (e.g., scratches, stains, dents, incorrect color or model, etc.).

In the event of a delivery error or damaged Product, the Client must refuse the parcel and report the issue immediately via the "Contact" section of the Website or by email at info@peralusa.com, within five (5) business days following delivery.

The Client must also confirm the claim by registered mail with acknowledgment of receipt sent to:

Acceptance of Delivery

No claim will be accepted after this period.

If the Client signs the delivery slip without reservation, the Product is deemed compliant and accepted, and no subsequent complaint will be admissible — even if the package was not opened in the presence of the courier.

Except in cases of non-conformity or hidden defect, any claim made without following the above procedure will be considered invalid.

Order Cancellation

The Client may cancel any order before it has been shipped, without providing a reason. To do so, the Client must contact PERALUSA / MEDIACREA PRODUCTION by email via the "Contact" section of the website. An email confirmation will be sent once the cancellation has been validated by our team.

Right of Withdrawal

In accordance with European Directive 2011/83/EU, the Client has a legal period of 14 calendar days from the date of receipt of the Product to exercise their right of withdrawal, without justification and without penalty, except for return shipping costs, which remain the Client's responsibility.

Applicable national withdrawal periods:

  • Belgium: 15 days (Belgian law)
  • Portugal: 14 days (Portuguese law)

Exceptions

The right of withdrawal does not apply to personalized or made-to-order Products, such as poufs customized with specific colors, stitching, embroidery, or logos, pursuant to Article L221-28 of the French Consumer Code.

Procedure and Return Conditions

The Client may submit a withdrawal request through the website's "Contact" section or by email to info@peralusa.com. The Product must be returned at the Client's expense, using a carrier or postal service of their choice, to the address provided by PERALUSA / MEDIACREA PRODUCTION upon approval of the return.

Returned items must be:

  • in perfect condition,
  • unused,
  • in their original packaging,
  • and accompanied by all accessories and documentation.

Upon receipt, each Product will undergo a quality inspection. If the return conditions are met, reimbursement of the Product price (excluding return costs) will be processed within a maximum of 30 days from receipt of the parcel.

If wear, damage, or use is observed, the refund amount may be adjusted to reflect the depreciation in value of the Product.

MEDIACREA PRODUCTION provides the Client with a legal warranty against hidden defects that may affect the Products sold, in accordance with the provisions of French law (Articles 1641 et seq. of the Civil Code), unless otherwise specified on the Website.

This warranty applies only if the Client can prove that the defect existed prior to delivery of the Product by MEDIACREA PRODUCTION.

The Client is responsible for having the Product examined at their own expense in order to obtain proof of the hidden defect.

The liability of MEDIACREA PRODUCTION shall in all cases be limited to the value of the affected Product.

No additional compensation may be claimed by the Client beyond what is expressly provided for under the French Consumer Code.

The PERALUSA brand is a registered and protected trademark with the INPI (French National Institute of Industrial Property), as is the domain name www.peralusa.com.

These elements are the exclusive property of SAS MEDIACREA PRODUCTION and may not be used, reproduced, or imitated without prior written consent.

It is strictly forbidden to create hyperlinks redirecting to or from other websites without the explicit authorization of MEDIACREA PRODUCTION.

All graphic, visual, and editorial content displayed on the Website — including photographs, videos, drawings, product descriptions, logos, and layouts — are protected by copyright law and, where applicable, by related rights belonging to their respective owners.

Any additional costs related to reshipment, storage, or a new delivery attempt shall be borne entirely by the Client.

The liability of MEDIACREA PRODUCTION is, in any case, strictly limited to the amount paid or payable by the Client for the order concerned, regardless of the cause or form of action.

Force majeure events, as defined under French law — including but not limited to strikes, labor disputes, riots, wars, pandemics, natural disasters, or major logistical disruptions — shall be considered grounds for exemption from liability.

The selection and purchase of Products are the sole responsibility of the Client.

The inability to use a Product, for example due to incompatibility or improper use, shall not give rise to compensation, refund, or liability, except in cases of:

  • proven hidden defect,
  • non-conformity,
  • product defect, or
  • valid exercise of the right of withdrawal in accordance with the French Consumer Code.

These General Terms and Conditions of Sale are governed by and construed in accordance with French law.

Before taking any legal action, both parties agree to seek an amicable resolution to any dispute relating to the formation, interpretation, or performance of the order.

This amicable process does not suspend or interrupt the statutory limitation periods applicable to warranty claims.

If no amicable agreement can be reached, any dispute or claim arising from the sale, including in the event of multiple defendants or a warranty claim, shall fall under the exclusive jurisdiction of the courts within the jurisdiction of MEDIACREA PRODUCTION's registered office.

If the buyer is a consumer (non-professional), the competent court shall be determined in accordance with the provisions of the French Code of Civil Procedure and the Consumer Code, allowing the consumer to bring proceedings before the court of their place of residence.

The General Terms and Conditions of Sale, all orders, email correspondence, and the sales contract concluded between the Client and MEDIACREA PRODUCTION shall be written in French for all territories covered by the Website.

In the event of a translation into another language, the French version shall prevail in the case of any discrepancy in interpretation or dispute.

If one or more provisions of these General Terms and Conditions of Sale are deemed null, invalid, unenforceable, void, illegal, or inapplicable pursuant to any law, regulation, or final ruling by a competent court, such a finding shall not affect the validity, legality, or enforceability of the remaining provisions.

The User or Client shall remain bound by their contractual obligations, and the modification or removal of the affected clause shall not alter the overall balance or validity of the contract, whose remaining provisions shall continue to apply in full force.
